Purpose and Scope

This Privacy Policy explains how Yeled v'Yalda Early Childhood Center, Inc. ("Yeled," "we," "us," or "our") collects, uses, discloses, retains, and safeguards information obtained through Yeled websites, applications, electronic forms, accounts, and related online services (collectively, the "Services").

This Privacy Policy is a general organizational notice. Depending on the program and the information involved, additional privacy notices, consents, authorizations, or program-specific requirements may apply. If a program-specific document conflicts with this Privacy Policy, the requirements applicable to that program and information will govern.

By accessing or using the Services, you acknowledge this Privacy Policy. Where consent or authorization is required, Yeled obtains it separately.

Changes to This Privacy Policy

Yeled may revise this Privacy Policy periodically. The revised version will be posted on this page with an updated effective date. Yeled will provide any additional notice or obtain any additional consent required by applicable law.

Information We Collect

A. Information collected automatically

When you use the Services, Yeled and its service providers may automatically collect information about your device and use of the Services, including:

  • Internet Protocol (IP) address and general network information;
  • Browser type, device type, and operating system;
  • Date, time, duration, and pages or features accessed during a visit;
  • Clicks and other interactions with the Services;
  • The referring website or page, when available; and
  • Cookie identifiers and similar technical information, as described below.

B. Information you provide

Yeled may collect information you provide when you create or use an account, complete or submit a form, register for or receive services, communicate with Yeled, participate in a survey, request assistance, or otherwise interact with the Services. Depending on the interaction and program, this information may include contact information, account credentials, demographic information, program or service information, communications preferences, and other information you choose or are authorized to provide.

C. Information concerning children

Yeled may receive information concerning children from parents, legal guardians, schools, healthcare providers, governmental agencies, and other authorized sources. Yeled uses and discloses this information to provide and administer services, fulfill program responsibilities, comply with applicable requirements, and for other purposes permitted by law.

Unless a particular Service expressly states otherwise, Yeled's public-facing websites are intended for use by adults and are not designed to collect personal information online directly from children. If Yeled operates a website or online service that is directed to children or knowingly collects personal information online directly from a child, Yeled will provide any notice, obtain any parental consent, and offer any rights required by applicable law.

How We Use Information

Yeled uses information for purposes reasonably related to operating the Services, administering its programs, and fulfilling its legal and contractual responsibilities, including to:

  • Provide, coordinate, and administer services and programs;
  • Create, maintain, and support accounts and applications;
  • Process forms, requests, registrations, and other submissions;
  • Provide permitted appointment reminders, scheduling information, administrative notices, alerts, and program updates;
  • Respond to questions, comments, requests, and requests for assistance;
  • Operate, maintain, secure, troubleshoot, and improve the Services;
  • Monitor and analyze performance, trends, usage, and activities;
  • Protect the safety, rights, property, and security of individuals, Yeled, and the Services;
  • Fulfill legal, regulatory, contractual, audit, reporting, and recordkeeping obligations; and

Yeled does not sell personal information. Yeled does not use personal information for unrelated commercial marketing purposes.

How We Disclose Information

Yeled may disclose information as permitted or required for the purposes described in this Privacy Policy, including:

  • Within Yeled, to personnel who need the information to perform authorized responsibilities;
  • To service providers that assist Yeled in operating its websites, applications, communication systems, and programs;
  • To governmental agencies, schools, healthcare providers, payors, contractors, or other entities when authorized or required for the applicable program or service;
  • To respond to subpoenas, court orders, governmental requests, and other legal or regulatory processes, as permitted or required by law;

Program-Specific Privacy Requirements

Depending on the program and the information involved, Yeled may be subject to the Health Insurance Portability and Accountability Act (HIPAA), the Family Educational Rights and Privacy Act (FERPA), the Individuals with Disabilities Education Act (IDEA), New York privacy and confidentiality laws, and other applicable federal, state, and local requirements.

This Privacy Policy does not replace any program-specific Notice of Privacy Practices, FERPA notice, consent, authorization, or other document required by applicable law or program requirements. Yeled uses and discloses information in accordance with the requirements governing the applicable program and record.

Monitoring of Yeled Systems and Networks

To the extent permitted by applicable law and Yeled policy, during your association with Yeled, we may monitor and review activity, content, and traffic on Yeled-provided networks, systems, and applications for operational, security, compliance, support, and investigative purposes. This may include activity involving Yeled-owned devices and personal devices used to access Yeled resources.

Cookies, Analytics, and Similar Technologies

Yeled may use cookies, analytics tools, pixels, web beacons, and similar technologies to support website functionality, security, performance, analytics, and user experience. These technologies may collect information such as IP address, browser and device information, pages visited, interactions with the Services, and referring pages.

Electronic Communications

Yeled uses text messages and email communications with program participants, parents, legal guardians, and other service recipients only after obtaining written consent where consent is required and only as permitted by applicable laws, regulations, program requirements, and Yeled policies. Consent does not authorize any communication prohibited or restricted by the requirements applicable to a particular Yeled program.

The types of communications Yeled may send by text message or email depend on the requirements applicable to the particular program. Communications will be limited to those permitted by applicable laws, regulations, program requirements, and Yeled policies. For programs that permit only administrative electronic communications, text messages and emails will be limited to matters such as scheduling, appointment reminders, attendance, logistical information, and requests to contact Yeled.

Electronic communications may be misdirected, forwarded, stored, intercepted, or accessed by unauthorized persons despite Yeled's reasonable safeguards. Yeled limits the amount and type of sensitive information included in standard text messages and emails and uses approved secure communication methods when required by applicable law, program requirements, or Yeled policy.

SMS Terms and Conditions:

A. SMS privacy

Yeled does not sell SMS opt-in information, consent records, or mobile telephone numbers or share them with third parties or affiliates for their own marketing or promotional purposes. Yeled may provide this information to service providers that process communications on Yeled's behalf, subject to applicable privacy and security requirements.

B. Types of SMS Communications

If you have consented to receive text messages from Yeled, you may receive communications permitted by the requirements applicable to your program, such as:

  • Appointment and scheduling reminders;
  • Attendance and logistical information;
  • Administrative notices and follow-up messages;
  • Requests to contact Yeled; and
  • Other program-related communications permitted by applicable requirements and Yeled policy.

C. Message Frequency

Message frequency may vary based on your interactions with Yeled and the requirements of the applicable program.

D. Message and Data Rates

Message and data rates may apply, depending on your mobile carrier and service plan. Yeled is not responsible for charges imposed by your carrier.

E. Opt-In Method

You may opt in to receive text messages by completing Yeled's written consent form or through another written method approved by Yeled. Consent to receive text messages is not a condition of receiving services unless otherwise permitted by applicable law and program requirements.

F. Changing Preferences or Opting Out

You may change or withdraw your electronic communication preferences at any time by notifying Yeled, replying STOP to opt out of text messages, or emailing unsubscribe@yeled.org to opt out from emails. Yeled will process the request promptly and within any timeframe required by applicable law and will provide confirmation where appropriate. Withdrawal of consent will not affect communications already sent or Yeled's ability to provide required notices through another permitted method.

Data Security

Yeled maintains reasonable administrative, technical, and physical safeguards designed to protect information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. No method of electronic transmission or storage is completely secure, and Yeled cannot guarantee absolute security.

You are responsible for safeguarding any account credentials issued to you. Do not share your password. When you finish using an account or application, sign out and close the browser, particularly when using a shared or publicly accessible device.

Data Retention

Yeled retains information in accordance with applicable legal, regulatory, contractual, and program requirements and Yeled's record-retention policies.

Account Information

Where a Yeled website or application permits users to create accounts, users may be able to review or update certain account information through the applicable system. To request assistance with correcting account information or suspending or deleting an account, contact info@yeled.org. Any correction, suspension, or deletion request remains subject to applicable legal, regulatory, contractual, program, and record-retention requirements.
